Terms at YTinspector
The agreement between us
Hi YouTube inspectors! These Terms of Service are the agreement that governs your use of YTinspector - our YouTube analytics tool for tracking channel statistics, historical snapshots, and competitor comparisons. They cover the rules of the road: what you can expect from us, what we expect from you, and how things work if something goes wrong.
We've tried to keep this readable, but it is still a legal document, and it affects your rights. Please read it carefully. A few sections - the disclaimers and the limitation of liability - are written in capital letters because the law asks us to make them conspicuous, not because we're shouting.
If anything here is unclear, email us at contact@ytinspector.com and we'll be glad to help.
These Terms of Service ("Terms") are a binding agreement between you and YTinspector.com ("YTinspector," "we," "us," or "our") and govern your access to and use of our website (located at https://ytinspector.com), our web application, and any related features or services we operate (collectively, the "Service"). These Terms incorporate our Privacy Policy by reference.
1. Acceptance of These Terms
By using the Service, you confirm that you have read, understood, and agree to these Terms. If you are using the Service on behalf of a company or other organization, you represent that you have authority to bind that entity to these Terms, and "you" refers to that entity.
2. Eligibility
You must be at least 16 years old (or the age of digital consent in your country, if higher) and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that the information you provide to us is accurate and complete.
3. The Service
YTinspector provides analytics and insights about YouTube channels and videos, including channel statistics, historical performance snapshots, trend analysis, and competitor comparison. The data we present is derived in significant part from the YouTube API Services and other sources, and is provided for informational purposes. We may add, change, suspend, or remove features of the Service at any time, as described in Section 17.
4. Your Account
To use most features, you'll need to create an account. You agree to:
- Provide accurate, current, and complete information when registering.
- Keep your login credentials confidential and not share your account.
- Be responsible for all activity that occurs under your account, whether or not authorized by you.
- Notify us promptly at contact@ytinspector.com if you suspect any unauthorized use of your account.
We may suspend or terminate your account if any information you provide is inaccurate, or if you violate these Terms (see Section 13).
5. Subscriptions, Billing, and Cancellation
5.1 Plans and Fees
The Service may be offered under free and paid plans. The features and limits of each plan, and the applicable fees, are described at the point of purchase. By selecting a paid plan, you authorize us and our payment processors to charge the fees for that plan using your chosen payment method.
5.2 Free Trials
We may offer a free trial. Unless you cancel before the trial ends, you authorize us to charge the applicable subscription fee when the trial converts to a paid plan. We reserve the right to determine eligibility for free trials and to modify or withdraw them at any time.
5.3 Automatic Renewal
Paid subscriptions renew automatically at the end of each billing period (for example, monthly or annually) at the then-current rate, unless you cancel before the renewal date. By subscribing, you authorize these recurring charges until you cancel.
5.4 Cancellation
You may cancel your subscription at any time from your account settings or by contacting us. Cancellation takes effect at the end of your current billing period, and you will retain access to paid features until then. We do not provide partial-period refunds except where required by law.
5.5 Refunds
Except where required by applicable law or expressly stated otherwise, fees are non-refundable and there are no refunds or credits for partially used periods. If you believe you have been charged in error, contact us at contact@ytinspector.com.
5.6 Changes to Fees
We may change our fees from time to time. We will give you reasonable advance notice of any price change, and it will take effect on your next billing period. If you do not agree to a price change, you may cancel before it takes effect.
5.7 Taxes
Fees are exclusive of taxes unless stated otherwise. You are responsible for any applicable sales, use, value-added, or similar taxes, other than taxes based on our net income.
6. YouTube API Services and Other Third-Party Services
YTinspector uses YouTube API Services to provide its features. Your use of the Service therefore also involves YouTube and Google:
- By using YTinspector, you agree to be bound by the YouTube Terms of Service, available at https://www.youtube.com/t/terms.
- Information accessed through the YouTube API Services is handled in accordance with the Google Privacy Policy, available at https://policies.google.com/privacy.
- You may revoke YTinspector's access to your Google account at any time via the Google security settings page at https://security.google.com/settings/security/permissions.
You agree not to use the Service in any way that violates the YouTube Terms of Service or the policies of any other third-party platform. A violation of those third-party terms is also a violation of these Terms. We are not responsible for the availability, accuracy, or practices of YouTube, Google, or any other third-party service, and your use of those services is governed by their own terms.
7. Acceptable Use
When using the Service, you agree that you will not:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Violate the YouTube Terms of Service, the Google API Services User Data Policy, or any applicable law or regulation.
- Resell, sublicense, or redistribute the Service or data obtained through it, or use it to build or train a competing product, except as expressly permitted by us in writing.
- Access the Service through automated means (such as scraping, bots, or scripts) other than interfaces we provide, or attempt to circumvent any rate limits, usage limits, or access controls.
- Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure, or attempt to gain unauthorized access to any part of it.
- Reverse engineer, decompile, or disassemble any part of the Service, except to the extent that restriction is prohibited by applicable law.
- Use the Service to harass, abuse, or harm others, or to infringe the intellectual property or privacy rights of any person.
- Introduce any virus, malware, or other harmful code, or probe, scan, or test the vulnerability of the Service.
We may investigate and take appropriate action - including suspending or terminating your access - against anyone who, in our sole judgment, violates this section.
8. Accuracy of Data and Analytics
The statistics, snapshots, and insights provided by the Service are derived from the YouTube API Services and other sources and may be delayed, incomplete, estimated, or inaccurate. YouTube data can change without notice, and metrics may differ from those shown in YouTube's own tools. The Service is provided for informational purposes only and is not a substitute for your own judgment. You should not rely on it as the sole basis for any business, financial, or other decision.
Independently calculated metrics. Certain figures the Service shows - including views-per-hour, outperformer, velocity, acceleration, engagement, growth and similar scores and rankings - are calculated independently by YTinspector from YouTube data. They are our own metrics, are not provided or endorsed by YouTube, and should not be interpreted as official YouTube figures. Raw statistics (such as view, like, comment and subscriber counts) are shown as returned by the YouTube API.
9. Intellectual Property
The Service, including its software, design, text, graphics, and all related intellectual property, is owned by YTinspector or its licensors and is protected by applicable laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal purposes. You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted. All rights not expressly granted are reserved. "YTinspector" and our logos are our trademarks and may not be used without our prior written permission.
10. Feedback
If you choose to send us suggestions, ideas, or other feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback for any purpose, without any obligation or compensation to you.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share information. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
12. Third-Party Links
The Service may contain links to third-party websites and services, including YouTube and Google. We provide these links for convenience and do not endorse or assume responsibility for any third-party content, products, or practices. Your dealings with third parties are solely between you and them.
13. Term and Termination
These Terms remain in effect while you use the Service. You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or if we discontinue the Service.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination - including intellectual property, disclaimers, limitation of liability, indemnification, and governing law - will continue to apply.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT ANY DATA OR ANALYTICS WILL BE ACCURATE OR COMPLETE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU USE THE SERVICE AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL YTINSPECTOR OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16. Indemnification
You agree to indemnify, defend, and hold harmless YTinspector and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of the YouTube Terms of Service or any third-party terms, or your violation of any law or the rights of any third party.
17. Changes to the Service
We are continually improving the Service and may add, modify, or remove features at any time. We may also suspend or discontinue the Service, in whole or in part, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service, except as required by law.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the Effective Date above and, where appropriate, notify you (for example, by posting a notice on the Service or emailing you). Your continued use of the Service after an update constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Service.
19. Governing Law and Dispute Resolution
If a dispute arises, we encourage you to contact us first at contact@ytinspector.com so we can try to resolve it informally. If we cannot, you agree that the dispute will be subject to the exclusive jurisdiction of the courts.
20. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements.
- Severability. If any provision is found unenforceable, the remaining provisions will remain in full effect.
- No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
